Myth: Hiring a Collection Agency will Damage Customer Relationships

Photo of two business people sitting across a table from one another with a laptop in between.
Reality: A professional approach can actually preserve relationships.

Many business owners worry that involving a third party will burn bridges. However, experienced firms understand the importance of maintaining professionalism and diplomacy.

A reputable agency:

  • Communicates clearly and respectfully
  • Focuses on resolution—not confrontation
  • Acts as a neutral third party to defuse tension

In many cases, this improves outcomes compared to internal collection attempts that may already be strained.

Myth: Debt Collection Agencies Use Harassment or Aggressive Tactics

Two people shaking hands with the RSD logo above them.
Reality: Professional agencies are legally prohibited from harassment or abusive behavior.

The Fair Debt Collection Practices Act (FDCPA) strictly regulates how debt collectors operate, banning harassment, threats, deception, and unfair practices.

Collectors cannot:

  • Call at unreasonable hours
  • Use abusive language
  • Misrepresent the debt
  • Threaten actions they cannot legally take

In fact, ethical agencies rely on respectful communication and proven processes—not intimidation—to resolve accounts.

Why Beginning-of-the-Year Debt Placement Makes Strategic Sense

A photo of someone's hands holding a fan of money with a leather couch background.
January and February are ideal times for businesses to reassess financial health and clean up lingering
receivables. Accounts that are over 120 days old with no communication rarely resolve themselves — but they often respond to professional collection efforts.

Placing these accounts early in the year helps free up working capital, improves financial clarity, and allows your internal team to focus on growth instead of chasing non-responsive debtors.

Discover how RSD helps businesses recover silent accounts while maintaining professionalism and protecting relationships in our latest article.

Why 120+ Day Old Accounts with No Communication Deserve Immediate Attention

A photo of a young man holding a smartphone to his ear, presumably waiting to start a call.
When an account passes 120 days with no response from the debtor, the likelihood of collecting through internal efforts drops sharply. Silence often signals deeper issues — cash flow problems, disorganization, or intentional avoidance.

At the start of a new year, continuing to carry these accounts can distort your financial picture and consume valuable internal resources. By placing silent, aged receivables with a professional commercial debt collection agency, businesses can improve reporting accuracy, reduce administrative strain, and increase the chances of recovery before the debt becomes too old to pursue effectively.

Learn more about when and why placing 120+ day old accounts with no communication is a smart business move in our latest article.

Inside Every Good Credit Policy: Limits, Terms & Consequences

A photo of a piece of paper that says "terms and conditions," representing a credit policy created by a debt collection company.
How can you make your credit policy more effective?

A robust credit policy should be put into writing, and clearly spell out:

  • Credit limits tailored to each customer’s risk profile and financial health.
  • Payment terms, including due dates and incentives (e.g. early-pay discounts or penalties for late payment).
  • Consequences for missed payments—such as stopping future orders, applying interest, or going to collections.

What if the policy is vague or missing?

Ambiguous or absent policies lead to these all-too-common pitfalls:

  • Clients use inconsistent standards to push back payment, blaming unclear terms.
  • Internal teams show favoritism—leading to inconsistent standards and confusion.
  • Businesses can’t take swift action on overdue accounts when consequences are not documented.

Benefits of Written Credit Policies

A photo of an open dictionary with the word "credit" being highlighted, representing the importance of credit policies to debt collection companies.
When was the last time you reviewed your credit policy?

The benefits of a clear credit policy are invaluable to your business. Here are a few of the immediate benefits:
  • Unified departments: Everyone—sales, finance, shipping, etc.—follows the same rules.
  • Empowered enforcement: AR teams can confidently apply penalties when terms are violated.
  • Reduced disputes: Clearly defined expectations help prevent misinterpretations and disagreements.
  • Improved efficiency: Staff know exactly how to act—taking out guesswork reduces delays.

Remember to review your credit policy quarterly, and make tweaks to any areas that are lacking results or efficiency.

How to Deal with Customer Push Back

Commercial Debt Collection
What do you do when a customer who owes you money won’t pay?

Not all customers will comply immediately, and some may dispute the debt or outright refuse to pay. Here are strategies to handle pushback effectively:

  • Stay Professional. Maintain a calm, professional, and empathetic tone to prevent further resistance.
  • Listen Actively. Understanding the customer’s reasons for non-payment can help tailor an effective solution.
  • Provide Documentation. Present invoices, contracts, and payment history to substantiate the claim.
  • Offer Solutions. Propose alternative solutions such as payment plans to make it easier for the debtor to settle the amount owed.

Negotiation Tactics

When dealing with delinquent accounts, negotiation can be a powerful tool. Consider these tactics to maximize recovery:

  • Offer Payment Plans. Breaking down the total amount into manageable installments can encourage payment.
  • Propose Settlement Offers. If collecting the full debt seems unlikely, offering a reduced amount for immediate payment may be a viable solution.
  • Set Firm Deadlines. Define clear deadlines for payment to create a sense of urgency and commitment.
  • Leverage Incentives or Consequences. Offering discounts for prompt payment or warning of potential legal actions can motivate the debtor to act.

Step-by-Step Guide to Debt Collection

Commercial Debt Collection
Does the debt collection process feel daunting?

RSD is here to walk you through it!

The debt collection process typically follows a structured approach, progressing from friendly reminders to more formal actions:

  • Initial Reminder. The process begins with a courteous reminder via phone, email, or letter shortly after a payment becomes overdue. The goal is to prompt the customer to pay without damaging the relationship.
  • Follow-Up Communications. If the debtor does not respond, follow up with additional emails, calls, and letters, emphasizing the urgency of resolving the outstanding balance. At this stage, reinforcing the importance of payment deadlines can be effective.
  • Final Notice. A more formal notification is sent, warning the debtor of potential consequences such as late fees, interest accrual, or escalation to external collection agencies.
  • Formal Collections. If the debt remains unpaid, you may need to escalate the matter through legal demand letters, debt collection agencies, or litigation as a last resort.

Three Reasons to Care About Terms and Conditions

Collection Agency
Why is it important to be familiar with the fine print?

  1. It sets clear expectations. Well-drafted terms and conditions clearly outline the debtor's obligations. This includes the amount owed, payment deadlines, and any additional fees or interest that may accrue. This clarity helps prevent misunderstandings and disputes down the line.
  2. It provides legal protection for creditors and collection agencies. Terms and conditions act as a shield for a collection agency. They outline the agency's rights and limitations, ensuring they operate within legal boundaries. This includes compliance with the Fair Debt Collection Practices Act (FDCPA) and other relevant regulations.
  3. It allows collectors to take action. In the event of non-payment, terms and conditions provide a legal basis for taking further action. This could include filing a lawsuit, garnishing wages, or placing a lien on property.

The Importance of Terms and Conditions

Collection Agency
Do you know the terms and conditions of your debtor’s contract?

Both creditors and collection agencies should understand the important role that terms and conditions play in a claims case.  Terms and conditions are the legal backbone of any contract, and when it comes to debt collection, they're no exception.

It's important to note that terms and conditions must be fair and transparent. Unfair or deceptive terms can be challenged in court, which can severely hurt a creditor’s case.

Terms and conditions are a vital part of a debt collector’s investigation. For more information about this, check out last month’s article.

Knowing When to Walk Away

Debt Collection Companies
At what point is a collected debt outweighed by the cost of legal action?

Though it’s not ideal, there are circumstances where it may be better to halt collection efforts:

  • Low Recovery Probability: If the debtor lacks assets or income to satisfy the debt, pursuing legal action may result in additional costs without a realistic chance of recovery.
  • Cost-Effectiveness: For small debts, the expenses associated with litigation (e.g. legal fees and court costs) may outweigh the potential recovery.
  • Time and Resources: Pursuing legal action can be time-consuming and resource-intensive. If the effort outweighs the potential return, it may be more efficient to cease collection efforts.
  • Disputes and Defenses: If the debtor disputes the debt and presents valid defenses that complicate the case, resolving the matter outside of court may be preferable.

Navigating debt collection requires a balanced approach, weighing financial considerations, legal rights, and practical realities. By carefully evaluating these factors and exploring alternatives, creditors can make informed decisions that maximize the chances of debt recovery while minimizing unnecessary costs and efforts. Factors Favoring Legal Action

Debt Collection Companies
Are you unsure whether to pursue a debt or walk away?

There are several scenarios where pursuing legal action might be the preferred route:

  • High Value Debt: For substantial debts, the potential financial gain from successful litigation may outweigh the costs and effort involved.
  • Clear Documentation: When you have clear, documented evidence of the debt and the debtor's obligation to pay, you have a stronger case in court.
  • Repeat Offender: If the debtor has a history of defaulting on debts or ignoring collection efforts, legal action may be necessary to compel payment.
  • Assets and Solvency: If the debtor has assets or a reasonable ability to pay but refuses, legal action can force compliance through wage garnishment or asset seizure.

Steps to Consider Before Filing Suit

Before deciding on legal action, consider these steps:
  • Negotiation: Attempt to negotiate a settlement or payment plan directly with the debtor. Sometimes, an agreed-upon resolution can avoid the need for litigation.
  • Mediation or Arbitration: Alternative resolution methods can be less costly and time-consuming than litigation, offering a middle ground between walking away and filing suit.
  • Legal Consultation: Seek advice from a debt collection attorney to assess the viability of litigation based on your specific circumstances.

Don’t Wait Too Long to Collect!

debt collection agency

According to Michigan debt collection laws, “for most collection actions, there is a specific period of time during which a creditor may pursue the collection of a debt. In Michigan, the filing of a breach of contract and/or open account action, for default of a credit card agreement, for example, must be done within the 6-year Statute of Limitations. MCL §600.5807(8). The relevant date for determining when the six-year Statute of Limitations begins to run is the date of the last activity on the account, whether it be a purchase or a payment made.”
